Migrants are falsely claiming to be victims of domestic abuse in order to stay in the country, a BBC investigation has found.
These protectionsโknown as the Migrant Victims of Domestic Abuse Concessionโare being exploited.
The investigation revealed how some migrants, both male and female, are deceiving British partners into relationships and marriage, and then making false domestic abuse claims after moving to the UK.
One Pakistani man explained that he had a problem: he wanted to leave his British wife to live with his mistress. However, his visa was tied to his marriage, and if he separated, he would have to leave the country.
An immigration adviser confirmed what he was willing to do. For ยฃ900, he would fabricate a claim, creating a story to present to the Home Office in order to secure the clientโs status in the UK.
If the application is successful, the individual is granted permission to stay in the UK for three months and can claim benefits.
During those three months, they can then apply for indefinite leave to remain in the UK, which grants foreign nationals the right to live, work, and study in the country permanently with no time limit.
This route is much faster than other paths to permanent residency, such as asylum.
The number of people claiming fast-track residency on the basis of domestic abuse has now reached more than 5,500 per yearโa figure that has risen by more than 50% in just three years.
