GRABe nga pang Bully NILA Kay atty. DISTRITO.
OFFICIAL STATEMENT
Bilang kandidato sa pagka Vice Mayor, ready ko ya mag atubang sa tanan nga isyu parti sa akon kapasidad, abilidad, binuhatan kag track records, but I am also ready to fight anyone who will attack my personal or private matters, including my DISABILITY, like this news article or feature in their official news page with the heading, “INDI KAMI BULAG, SA KALBO KAMI sa pamangkot kung sin-o ila pagabutuhon bilang vice mayor” kag klaro nga naga refer sa akon bilang kontra sang kandidato ni Bing Leonardia nga si El Cid Familiaran.
I am totally appalled and disappointed sa Aksyon Radyo, whom I have given so much respect and courtesy, past and present, considering that I am also a graduate of Mass Communication at the University of St. La Salle. I am also disappointed with Mayor Evelio Leonardia, who unfortunately, is also a lawyer and should know all along the legal and moral implication of his speech, not to mention of having a son who is also a PWD.
I am fighting them indi tungod sa akon kaugalingon lamang, kundi sa linibo nga mga Persons with Disability sa bilog nga syudad sang Bacolod. Tapos nako sa tyempo nga sang una, ihibi ko lang or isugid sa akon ginikanan ukon maestra kung ako pakahuy-an ukon sunlugon nga BULAG.
Such statement promotes bullying and discrimination against PWDs and it was very disappointing that it came from the father of the city, who is a lawyer himself and who clearly insinuated to the crowd and drew them to make a mockery of my disability and such was amplified by Aksyon Radyo being paid to broadcast their opening salvo.
Aksyon Radyo should have been more circumspect in publishing this kind of news article on their official page. They know the rules, they know their ethical standards, and they know the legal implication of such insensitive action.
Such is a clear violation of Sections 39 and 41 RA 9442 or the Amendatory Law of RA 7277 or the Magna Carta for Disabled Persons particularly the Public Ridicule and Vilification.
PUBLIC RIDICULE is defined as an act of making fun or contemptuous imitating or making mockery of persons with disability whether in writing, or in words, or in action due to their impairment/s. While VILIFICATION is defined as the utterance of slanderous and abusive statements against a person with disability, and/or an activity in public which incites hatred towards, serious contempt for, or severe ridicule of persons with disability.
Ang pagbayular sini nga layi may ara sang nagaka igo nga penalidad nga kapresuhan nga 6 months up to 2 years, multa nga 50,000 asta 100,000 kag pag kanselar sang prangkisa.
Ini bayolasyon man sang Libel suno sa Revised Penal Code kag Cyber Libel suno sa Cyber Crime Law.
Aside sina, ang nasambit nga pag broadcast kag pag post sang Aksyon Radyo naga bayular sang Code of Ethics and Broadcast Code sang Kapisanan ng mga Broadkaster ng Pilipinas (KBP) nga nagahambal nga ang pisikal nga kapaslawan or disability indi dapat paggamiton sa paagi nga makapahuya, makapanubo kag makapaguba sa iya pagkatawo.
Lastly, of all people, Atty. Leonardia should have been more sensitive in this issue considering that he has a child who is a PWD. Kung sya bilang amay, indi ayhan masakit para sa iya kung ang iya anak himoon ang pareho sang ginhimo ya sa akon? Indi ayhan ini masakit para sa akon iloy kag pamilya? Kabay pa nga indi ini matabo sa iya.
