Compliance Over Convenience: Why It Matters for Your Drone Projects
In the drone industry, the pressure to “just get the data” is real. Tight deadlines and competitive pressures can tempt operators to take shortcuts — like running a quick oblique flight over a busy construction site or parking lot.
This approach often violates 14 CFR §107.39 (Operations over Human Beings) and Subpart D requirements. It’s not safe to assume that every assigned flight plan is automatically compliant. The Pilot in Command (PIC) is solely responsible for ensuring every operation meets Part 107 — not the network.
Quick reference on 107.39: No person may operate a small unmanned aircraft over a human being unless that person is:
• Directly participating in the operation, or
• Protected by a covered structure or stationary vehicle, or
• The operation meets a specific category under Subpart D (with compliant aircraft and documentation).
There’s no gray area for incidental or transitory flight over people, even in moving vehicles. Without the proper aircraft category, waiver, or Document of Compliance, it’s simply not allowed.
