Court Orders UNIMA to Readmit Suspended Education Students and Release Withheld Results
The High Court in Zomba has ordered the University of Malawi (UNIMA) to readmit two suspended final-year Bachelor of Education students and release their withheld examination results pending the full hearing of their case.
Justice Ntaba granted Hannah Banda and Amos Tsekani leave to commence judicial review proceedings and issued an interlocutory injunction in their favour.
The court restrained the University Council from enforcing the suspension, directed the institution to release their December 2025 semester examination results, and allowed the students to register for and attend the current semester until the matter is fully determined.
The suspensions followed student protests over the introduction of fees for the mandatory 9th Semester Teaching Practice, a decision the university later reversed.
Although the students appealed the suspension in November 2025, the appeal had not been heard by the time the matter went to court.
One of the students' lawyers, Traves Majiga of KD Freeman & Associates, confirmed the development.
"Yes, the Court today has granted us leave for judicial review and an interlocutory injunction," he said.
"The injunction restrains the Council of the University of Malawi from continuing to enforce the suspension and requires the university to release the students' examination results for the semester ending December 2025, while also permitting them to register for and attend the current academic semester pending the full determination of the matter," he added.
