Precedents matter.

If today's legal standard allows access to a public official's financial records based on a certain level of evidence, the same standard could be invoked in future cases involving other officials—regardless of political affiliation.

𝗜𝗦 𝗜𝗧 𝗥𝗘𝗔𝗟𝗟𝗬 𝗡𝗢𝗧 𝗔 𝗙𝗜𝗦𝗛𝗜𝗡𝗚 𝗘𝗫𝗣𝗘𝗗𝗜𝗧𝗜𝗢𝗡?

House Prosecutor Chel Diokno explained that the subpoena for Vice President Sara Duterte's bank, tax, and AMLC records is not a fishing expedition because these documents are connected to Article II (Unexplained Wealth) of the Articles of Impeachment.

He compared the SALN to a snapshot of a public official's finances, the Income Tax Return (ITR) to a short video, and said that only the bank records can reveal the entire financial picture.

However, this raises an important legal question:

If the prosecution already had sufficient evidence to support Article II when it filed the Articles of Impeachment, why is it still necessary to obtain years of bank, tax, and AMLC records to complete the financial picture?

In legal proceedings, a case is generally expected to be filed based on evidence already available. A subpoena is typically issued to obtain specific and relevant evidence that has already been identified—not to broadly search for evidence that might strengthen a case after it has been filed.

This is why some legal observers and supporters of the Vice President argue that the request resembles a fishing expedition—an attempt to discover additional evidence in the hope that something incriminating may be found.

On the other hand, the prosecution maintains that the requested records are directly relevant to proving the allegations already contained in the impeachment complaint.

Ultimately, the Senate impeachment court will determine whether the subpoena requests are sufficiently specific, relevant, and legally justified.
