Terms of Agreement:
1. COLORSPLASH PHOTOBOOTH will arrive at event venue approximately 30 minutes before schesduled rental start time to setup equipment and make sure that everything is operational. This allotted time is given assuming that there are no transportation obstacles (absence of elevator for non-ground floor event venues, etc.) and venue technical/logistical/administrative limitations that will impede or make delivery and setup of the Photo Booth unachievable.
2. It is the sole responsibility of the client to secure permission of the event venue for COLORSPLASH PHOTOBOOTH to setup and operate the Photo Booth at this event. The client is responsible to inform COLORSPLASH PHOTOBOOTH of any restrictions at the site that may affect the setup or operation of the Photo Booth and/or Your Photo Booth Company’s ability to adequately perform their duties. The client understands that such restrictions may adversely affect the overall experience and/or quality of photos, and that COLORSPLASH PHOTOBOOTH is not responsible for the consequences of such restrictions.
3.COLORSPLASH PHOTOBOOTH takes the utmost care regarding equipment function, photo quality, and printing. However, due to the nature of technology, some downtime may occur. COLORSPLASH PHOTOBOOTH guarantees its equipment to be operational at least 80% of the scheduled rental time, and will refund a pro-rated amount of the rental price for any downtime beyond this caused by equipment malfunction.
4. In the event COLORSPLASH PHOTOBOOTH fails to comply with the terms of this agreement, COLORSPLASH PHOTOBOOTH will only be liable for the payments received.
5. Client agrees to indemnify COLORSPLASH PHOTOBOOTH against any and all liability from any claims, actions, suits, costs, damages or liabilities including but not limited to liability for personal injury of any person at the event, and/or property damage.
6. COLORSPLASH PHOTOBOOTH reserves all rights to the photographs captured during event and may use for demonstration, publication, or other purposes. Original media and copyrights remain the exclusive property of COLORSPLASH PHOTOBOOTH
7. Any individual aspects or particular requests should be made prior to your signing this agreement. a. Notes:_________________________
8. This agreement includes the entire understanding of the parties. Any modifications of this agreement must be in writing and signed by both parties.
9. This agreement shall be governed by the law of the Republic of the Philippines.
10. The total price for the above services and product(s) is (package price + additional if theres any+ travel fee if not within Lipa and Mataasnakahoy area ). Payments shall be due at the following times: 30% initial deposit ( 1,050 php); the balance is due 10 days before the event date. Payments made before The Event date shall be defined as "Retainer(s)" and are non-refundable upon cancellation of The Event, but may be re-applied subject to availability if The Event is rescheduled. Canceled Events must be
rescheduled within 60 days of notice of cancellation in order to re-apply retainer(s).
11. If The Event is canceled, the Client must notify COLORSPLASH PHOTOBOOTH of his/her desire to cancel the contract, and upon receipt of that information, COLORSPLASH PHOTOBOOTH will provide Client with a cancellation form. This form must be filled out in its entirety and sent to COLORSPLASH PHOTOBOOTH by certified mail, return receipt. Otherwise, The Client shall be responsible for the payment schedule as set forth above. Rescheduled events shall be subject to standard pricing in effect on the date to which the event has been rescheduled, and any pricing changes shall be documented in a separate addendum.
12. If COLORSPLASH PHOTOBOOTH cancels the contract due to an impairment or a non-compliant Client (Client violates any terms of the Contract, COLORSPLASH PHOTOBOOTH may refund all or a portion of the fees already received. Any fees paid for services/products already completed will not be refunded.
13. Force Majeure. Neither Party shall be liable to the other for delays or failures in performance resulting from causes beyond the reasonable control of that Party, including acts of God; acts of government or its agencies, including laws, regulations, and judicial action; strikes or other labor disputes or disturbances; power disruptions; riots or civil disturbances; acts of war; or communication, utility or transportation failures, or failure of supply. The obligation of the Party unable to perform, as set forth in this Section 2.7 (“Delayed Party”) shall be suspended, and non-performance shall be excused, during such force majeure event, subject to the Delayed Party’s compliance with the following. The Delayed Party shall give the other Party written notice of its inability to perform and a description, in reasonable detail, of the cause of the inability and will use diligent efforts to remedy the situation and remove, so far as is commercially reasonable and as soon as practicable, the cause of such inability. In the event that the Delayed Party is unable to remove the force majeure event, and resume performance in accordance with the other terms of this Agreement, within thirty (30) days of the occurrence of the event, each Party shall have the right to terminate this Agreement by providing written notice of termination to the other.
14. A 30% ( 1,050 php)non-refundable deposit is required to reserve your event date. Final payment is due 10 days prior to event.
15. Any failure to make timely payments may result in cancellation of this contract , COLORSPLASH PHOTOBOOTH will make every attempt to provide notice to Client before cancellation occurs.
