When drafting a contract for a drone service provider (DSP), certain essential elements should be included:

📌 Identification of Parties: Clearly state the legal names and contact information of both the DSP and the client.

📌 Scope of Work: Describe in detail the services to be provided, including specific deliverables, project timelines, and any limitations or exclusions.

📌 Pricing and Payment Terms: Specify the agreed-upon pricing structure, payment schedule, and any additional costs or expenses. Include provisions for late payments or non-payment.

📌 Insurance and Liability: Define the insurance requirements for the DSP, such as liability insurance, and outline the responsibilities and liabilities of both parties in case of accidents or incidents.

📌 Intellectual Property: Clarify the ownership and usage rights of any intellectual property, including copyrights, trademarks, or patents, resulting from the drone services.

📌 Termination and Dispute Resolution: Specify the conditions and consequences for termination or cancellation of the agreement, as well as a mechanism for dispute resolution, such as mediation or arbitration.

📌 Governing Law and Jurisdiction: Identify the applicable governing law and the jurisdiction where any legal disputes will be resolved.

❗️Responsibilities of a client when a drone mission is flown

Previously we talked about the responsibilities of a drone service provider (DSP) when it comes to flying a mission. In order for a drone mission to be successful and seamless, you as a client should be aware of your responsibilities:

1️⃣ Giving an early notice: the client should provide the DSP with enough notice in order for them to have enough time to obtain required airspace authorizations and to ensure the mission can be flown safely and in accordance with the law.

2️⃣ Providing clear instructions: clients should provide clear instructions to the DSP regarding the scope of the mission, including the desired altitude, location, and any specific areas/objects that need to be captured by the drone.

3️⃣ Providing an access: the client shall provide the DSP with the right to enter the service location.

4️⃣ Obtaining necessary permissions: it is the client’s sole responsibility to notify any governing authority over any property (i.e. homeowners, building management, project managers, security personnel, etc.) of the mission taking place in the vicinity with enough anticipation to ensure all parties are aware of the date/time and place of the operation.

5️⃣ Ensuring safety: clients are responsible for ensuring the safety of people and property in the area where the drone mission is flown (for example, notifying a construction team of the drone mission). They should also ensure that the DSP is aware of any potential hazards or obstacles in the flight path and that appropriate measures are taken to mitigate risks.

6️⃣ Respecting privacy: it is highly recommended that the client notifies and obtains consent from all neighboring landowners and other interested parties whose property may be photographed/filmed prior to the flight.

7️⃣ Communicating effectively: clients should maintain effective communication with the DSP throughout the mission to ensure that any issues or concerns are addressed promptly. Clients should also submit any mission update requests, including rescheduling and cancellation requests, within an adequate timeframe.

| Factors affecting the quality and type of drone footage |

There are a lot of factors apart from the pilot skills, the equipment used and the editing skills, that are out of the pilot’s control and can impact the quality and type of drone photos and videos. As a client, you should be aware of the following to avoid the “expectation vs reality” kind of scenario:

◾ Location: Certain requested shots from specific locations, directions and heights, quoted to be undertaken, may not be possible on the day due to obstacles or if it's deemed unsafe to to do so. In this case, the best possible alternative shots are usually supplied and these are deemed to fulfill the contract.

◾ FAA regulations, conditions and limitations: Certain requested shots from specific locations, directions, heights and at particular times may not be possible on the day due to the FAA limitations and regulations. Drone flights may not be allowed at all in certain areas - restricted airspace, such as airports and military bases.

◾ Lighting conditions: Like with any type of photography and videography, lighting is a crucial factor in the quality of the footage. Drones can be affected by harsh sunlight, low light, and other challenging lighting conditions. As a client, you should always express your preferences when it comes to lighting on the day of the shoot (clear skies, partially cloudy, cloudy, morning/evening light, dusk) to avoid any frustration.

◾ Drone stability: Although drones have built-in self-stabilising measures, they're still subject to movement by the wind and will tilt whilst being held against the wind. This may impact the image quality, steadiness and the angle of photos/videos.

◾ GPS and radio interference: Too much GPS/radio interference may impact the flight, and thus the image quality, steadiness and angle of drone photos/videos.
